On April 21, a preliminary hearing was held at Baku Court of Grave Crimes on the case of Anar Mammadli, head of the Election Monitoring and Democracy Studies Center (EMDS), Bashir Suleymanli, EMDS executive director, and Elnur Mammadov, head of the Volunteers International Cooperation Public Union. Judge Rauf Aliyev was presiding over the hearing. During the process, the judge granted a petition by Anar Mammadli's lawyer asking to let his client out of the courtroom cage and sit beside him. The rest of the petitions requesting permission for video recording at the hearing, termination of the criminal proceedings and replacement of pretrial detention measure were not granted. Note that Anar Mammadli was detained on 16 December 2013, on charges of running business without registration, tax evasion and abuse of office by influencing election results. The court ordered him to serve three months of pretrial detention. On 6 March 2014, Mammadli's pretrial detention term was extended by three months. On 19 March, preliminary investigation of the case was completed and Mammadli, as well as Suleymanli and Mammadov, who had been given a restraining order, faced additional charges of service forgery and appropriation of property. On April 20, parents of arrested NIDA activists started hunger strike at the headquarter-apartment of Musavat Party. They protest the prosecutor’s lengthy prison sentence request for their sons ranging from 6 and a half to 8 and a half years. Zaur Gurbanli’s mother Sakina Gurbanova, Rashadat Akhundov’s mother Matanat Akhundova and Shahin Novruzlu’s mother Mehbara Novruzova joined the hunger strike. Defendants themselves have been continuing hunger strike at the Kurdakhani investigation facility since April 17. On April 21, press conference was held at the headquarter-apartment of Musavat Party in connection with arrested members of NIDA movement. The chairman of the Youth Committee Ahliman Abbas demanded immediate release of NIDA activists on behalf of the party members and Azerbaijani youth. NIDA Board member Turgut Gambar called on everyone to sign the online petition on Amnesty International website for release of NIDA activists. Note that NIDA activists and their parents are on a hunger strike started due to the prosecutor’s request of lengthy prison terms for the youth in the April 17 process. On April 24, there was a powerful explosion in one of the oil tanks in Bayil settlement. Fire started after the blowup. The employee of Objective online television Shirin Abbasov was subjected to pressure by the police and employees of Emergency Situations Ministry while filming video material in connection with explosion of oil tank. He noted that some of the MES employees and police put physical pressure on him without introducing themselves. On April 21, Zerkalo newspaper correspondent Rauf Mirgadirov was ordered to be held in pretrial detention for 3 months by a Nasimi district court decision. In a briefing held after the court hearing, the journalist's lawyer Fuad Agayev said that he met his client at isolation ward of the Ministry of National Security. "Rauf told me that he does not admit such grave charges and had not committed any crime. I condemn the journalist's deportation and his handover to Azerbaijan, because this happened through violation of Rauf's rights", said the lawyer. Note that Rauf Mirgadirov was arrested on April 19, immediately after being deported from Turkey. He is charged under Article 274 (treason) of the Criminal Code. On April 22, 24 and 25, the trial of NIDA members and activist Ilkin Rustemzadeh continued in Baku Grave Crimes Court with lawyers’ speeches. Lawyers Yalchin Imanov and Nemat Karimli speaking in the process noted that NIDA activists were arrested due to exercising freedom of expression and their rights stipulated by the European Convention articles #3 (prohibition of torture), #5 (right to liberty and security), #6 (right to a fair trial), #8 (right to respect for private and family life) and #10 (freedom of expression) have been violated. At April 24 process Uzeyir Mammadli's lawyer Fakhraddin Mehdiyev, Bakhtiyar Guliyev's lawyer Javad Javadov, Zaur Gurbanli's lawyer Elton Guliyev, Mahammad Azizov's lawyer Fariz Namazli and Rashadat Akhundov's lawyer Namig Hajiyev in their speeches noted that charges against defendants were groundless and false, and asked the court to acquit them. At April 25 hearing, lawyers Elchin Sadigov and Khalid Bagirov also called on the judge to acquit defendants. Note that the seven activists of NIDA Civic Movement were detained in April and May of 2013 and are charged with planning to use Molotov cocktails during a mass protest in Baku on March 10, 2013. Some of the youth are also charged with illegal possession of drugs. Member of the “Azad Genjlik” (Free Youth) organization Ilkin Rustemzadeh, who is co-accused with NIDA activists, was detained on May 17, 2013. He was first charged with hooliganism, then additionally with organizing riots and attempting to participate in them. On April 23, parents of NIDA activists decided to pause the hunger strike temporarily. According to Zaur Gurbanli’s mother Sakina Gurbanli they will hold off until the day the verdict is announced. If the judgment of the court is not fair, the action will be restored. Note that the mothers of Zaur Gurbanli, Rashadat Akhundov and Shahin Novruzlu launched hunger strike on April 20. Two days later Shahin Novruzlu’s aunt joined the action. A court hearing was held in Facebook activist Abdul Abilov's case at Baku Court of Grave Crimes on April 24. Judge Ahmad Guliyev presided over the hearing. Muzaffar Mammadov, employee of the Organized Crime Department of the Ministry of Internal Affairs who led the operation group that detained Abilov and operative Ibrahim Kazimov gave testimony in the process. Note that Abdul Abilov was admin of the Facebook page "Let's Say No to Flatterers" known for sharp criticisms of the authorities. He was detained on November 22, 2013 and charged with illegal possession, storage, manufacturing or sale of drugs which stipulates a prison sentence for up to twelve years. April 25 sitting of Baku Appeal Court presided over by judge Aflatun Gasimov heard former parliamentarian Gular Ahmadova's appeal against conviction. The appellant's lawyers filed motions for allowing Ahmadova to sit beside them and dropping embezzlement charge brought against her. The first request was not granted, whereas the second was left unconsidered. Taking the witness stand, forensic expert Humbat Valiyev noted that the CD given to them was not original, but a copy. According to him, through the whole phonogram, speech matched the audio track, and articulation was plain. Note that former MP Gular Ahmadova is serving her 3-year prison sentence delivered on December 3, 2013 on charges of embezzlement and concealment of crime. Ahmadova's lawyer Afsar Talibov has appealed against the court's decision. On April 24, a new charge was filed against the prosecuted leader of the Ganja-based “Intelligent Citizen” Enlightenment Center, Hasan Huseynli, as he personally told the Objective TV today. According to Huseynli, the additional charge was brought under Article 228.4 of the Criminal Code (illegal possession of a cold weapon) and called it the follow up of the false case. Note that Hasan Huseynli was detained on March 31, 2014 and was held in Kapaz District Police station detention facility. He is charged with stabbing Arzu Gahramanov. Gandja City Main Police Office has opened a criminal case under Article 221.3 of the Criminal Code (hooliganism committed with use of a weapon). A restraining order has been imposed on Huseynli, which requires him not to go elsewhere without permission while under investigation. “The trial of NIDA movement activists is unfair, biased and politically motivated”, Elshan Hasanov, leader of the “Azerbaijan Without Political Prisoners” Public Alliance said at the press conference held on April 25 in Institute for Reporters’ Freedom ad Safety. The Alliance called for the acquittal of the NIDA activists. Because none of the criminal offenses they are accused of has been proved. They have been arrested due to participation in the unsanctioned protest against soldier deaths. But Azerbaijani laws guarantee the freedom of assembly of people. In the conclusion, it was deemed important to consolidate civil society efforts in order to solve the problem of political prisoners and eliminate harassment of activists. On April 25, Baku Appeal Court denied the appeal filed against Nasimi Court decision on pretrial detention of journalist Rauf Mirgadirov, who was arrested on treason charges. In an interview after the hearing, lawyer Fuad Agayev said the court without any legal basis rejected the request for replacement of the pretrial detention measure. Note that Rauf Mirgadirov, correspondent of Baku-based Zerkalo newspaper, was arrested by MNS employees on April 19 after being deported to Baku from Turkish capital city Ankara where he had been living since 2010. He is charged under Article 274 (treason) of the Criminal Code. Nasimi district court has ordered him to serve 3 months of pretrial detention.
