On May 12 through 15, the trial on the case of the chairman of Election Monitoring and Democracy Studies Center (EMDS) Anar Mammadli, EMDS executive director Bashir Suleymanli and head of a partner NGO, Elnur Mammadli continued with witness testimonies in Baku Court on Grave Crimes. Alishan Mirzayev, Avtandil Mammadov and Asef Ahmadov testifying as witnesses confirmed their cooperation with the organization in all projects and receiving salary. Based on the motions by the defense, new witnesses were questioned during the hearing. Expert in forensic accounting of the Ministry of Justice gave testimony and noted that the opinion given by him was based on the materials by the investigation. EMDS chairman Anar Mammadli said that investigators questioned him first as a witness, then as the accused. He noted that during a search in the EMDS office not only financial documents, but also educational materials were seized, which is another proof of the political nature of this case. Mammadli said that after the cancellation of the EMDS’ registration, he and other members of the NGO were forced to engage in financial transactions projects as individuals. Mammadli regarded the refusal to register the EMDS as political discrimination. Mammadli called the act of checking the financial activity of the EMDS and VICPU unreasonable as it is unclear to what documents the inspectors referred, because previously no cameral or on-site audits were conducted. Bashir Suleymanli and Elnur Mammadov also rejected all of the charges, calling them politically-motivated. The defense filed a motion for removal from the evidence list handwriting expert opinions and the inspection act which forms the base of the charge. The judge dismissed the motion noting that it would be considered in the final decision. Then he announced the conclusion of judicial investigation inviting the public prosecutor to make his speech. Public prosecutor asked time out to prepare. Note that Anar Mammadli, head of the NGO EMDS, was detained on 16 December 2013, on charges of running business without registration, tax evasion and abuse of office by influencing election results. He was sent to pretrial detention straight away, while the two other accused, EMDS executive director Bashir Suleymanli and Volunteers International Cooperation public union director Elnur Mammadov were prohibited to leave Baku until trial. On March 19, the accused faced additional charges of service forgery and appropriation of property. On May 12 and 14, the trial on the case of Bizim Yol newspaper journalist Parviz Hashimli and his alleged accomplice Tavakkul Gurbanov continued in Baku Grave Crimes Court, under the chairmanship of Judge Novruz Karimov. The public prosecutor Rahil Ismayilov asked the court to order 9 years prison term for Parviz Hashimli and Tavakkul Gurbanov. Lawyers of Parviz Hashimli Elchin Sadigov, Bahruz Mammadov and Fariz Namazli requested acquittal reasoning that the charges are false and were not proven during trial. Hashimli pleaded not guilty and requested acquittal from the court. On May 15, the verdict on the case of journalist Parviz Hashimli and Tavakkul Gurbanov was announced. By the judge’s decision, Hashimli was sentenced to 8 and Gurbanov to 8 and a half years in prison. Note that Bizim Yol newspaper journalist and moderator.az editor-in-chief Parviz Hashimli was detained on September 17, by employees of the Ministry of National Security. Main Investigation Department of MNS launched a case against him with three articles of the Azerbaijani Criminal Code: Article 206.3.2 (smuggling of firearms on preliminary arrangement by an organized group), 228.2.1 (illegal purchase, transfer, selling, storage, transportation and carrying of firearms, their accessories, supplies and explosives by an organized group) and 228.2.2 (the same acts committed repeatedly). On May 13, Baku Court on Grave Crimes held a hearing on the case of Facebook activist Omar Mammadov who is charged with illegal drug dealing. The process was chaired by Judge Eldar Mikayilov. Two employees of the Interior Ministry's Main Drug Enforcement Department, Agil Aliyev and Khayal Nasibov, as well as two circumstantial witnesses, Elnur Maharramov and Jeyhun Aliyev, testified as a witness in the process. The policemen told the court that Mammadov was arrested based on the information about his drug possession. Mammadov stated that an employee of the Drug Enforcement Department, by surname Alakbarov, punched him 8 times in the ribs to make him give self-incriminatory statement. Mammadov himself noted that when he was detained there were no circumstantial witnesses, that he saw all these men at Drug Enforcement Department. Note that Omar Mammadov is a member of Civil Solidarity party and the head of the “Akhin” (Flow) youth movement. After his arrest he re-joined NIDA movement. Mammadov was active user of social networks. Notably he was one of the admin of the Facebook Page “Exclusives from AzTV” which shared cartoons, photo collage, and comments making fun of the officials' mistakes. In January of 2014 he was arrested on charge of drug possession. On May 14, National Council held discussions on political prisoners and torture facts in the country at the press center of the Institute for Reporter's Freedom and Safety. Members of the National Council, human rights defenders, representatives of international organizations and some embassies participated in the conference. On May 14, the Supreme Court dismissed a cassation appeal against the decision of a preliminary appeal court hearing filed by religious blogger Rashad Ramazanov, who was convicted of drug charges and serving a 9 year jail sentence. Note that Blogger Rashad Ramazanov was detained on 9 May 2013, near the “January 20” metro station and taken to the Department for Combating Organized Crime. The police reportedly found 9 grams of heroin on the blogger. Ramazanov rejects the charges. On 13 November 2013, Baku Grave Crimes Court sentenced the blogger to 9 years in jail. All the houses located in Darnagul highway area have been demolished in connection with road broadening for 2015 Baku Olympic Games. The residents have been resettled to other places under various terms. But the Huseynov family has not left their apartment up today as they do not agree to the conditions laid down by the government. The family, who is forced to live in a house full of dust, claim that their property right has been violated. Murad Huseynov notes that since May 2013 they have been made to live in this apartment without energy, gas and water supply. Huseynov said the reason for their concern is mismeasurement of their apartment’s area and the amount of compensation they are offered. On May 16, Baku Appeal Court dismissed the complaint of Leyla Yunus, director of the Institute for Peace and Democracy in connection with the search conducted in her apartment. Meantime, Baku city, Nasimi district Court refused to hear the motion of Yunus for her personal search at Baku airport. Note that the inspector of Investigation Department of Prosecutor General's Office on Serious Crimes and some employees conducted search in the apartment and office of Leyla Yunus, director of the Institute for Peace and Democracy. During the search Arif Yunus' books, different print materials, also conference materials attended by the Yunus were confiscated. Leyla Yunus and her husband Arif Yunus were detained at the Baku airport on April 28, while leaving for Doha.
